Terms & Conditions

The Everlasting is a subscription service billed at $20 per month after a 5-day free trial, unless you hold a complimentary or founding membership, or your story’s recording is covered by a one-time purchase — the mini-documentary gift (section 2A) or the 12 months of recording a Life Portrait can include (section 2B) — which has no subscription at all. You may cancel at any time from My Account; cancellation stops future billing and your access continues through the end of the paid period. You are responsible for keeping your login secure and for activity under your account.

You may purchase The Everlasting as a gift. When you do, you fund the recipient’s story — with a monthly membership, or with a one-time payment as described in section 2A or 2B — and become a “historian” who can help build it. The person the story is about (the “subject”) sets their own consent and controls their story once they claim it. A story may have up to three historians. At most one membership funds a story at a time; a one-time purchase such as the Life Portrait can be made by the storyteller or by any historian who keeps the story, alongside a membership.

A one-time gift is a single payment for one person’s story. The price is shown before you pay and is charged once. It is not a subscription and it never renews: you will not be charged again for that story.

The storyteller and their family have 12 months from the date of purchase to record. A 1–2 minute trailer is made once the storyteller has recorded 6 conversations with Jess, 2 family members have recorded interviews with Jess, and 25 photos or videos have been uploaded. A 10–15 minute mini-documentary is made once there are 18 conversations, 5 family interviews and 80 photos or videos. Every film is made from what the family records; if less than this is recorded within the 12 months, the family keeps every recording and any film already made.

A story paid for once is not deleted when the recording year ends. The recordings, photos and films stay available to watch and download. The storyteller can still delete any recording they choose.

The Life Portrait is a 60–75 minute documentary of one person’s life, made by our team. It costs $800, charged once. It is not a subscription and it never renews.

The storyteller may buy it for their own story; a historian may buy it for a story they keep; anyone may buy it as a gift for someone who has not started a story. A story has at most one Life Portrait.

We make it once the story reaches 30 recorded interviews, 5 interviews contributed by family or friends, and 100 photos or videos, and the storyteller has answered a short set of questions about the film. We aim to deliver it four to six weeks after everything is in — the three marks reached and the answers submitted. Before delivery we send a private first cut to the storyteller, make reasonable changes they ask for, and finish the film only once they have approved it. If the storyteller is unable to review it, the buyer reviews it in their place. The finished film is delivered as a private link.

Recording depends on the story’s membership on the day the Life Portrait is bought. If a membership pays for the story and is not set to end, the membership covers recording and the Life Portrait adds none. Otherwise — the story has no membership, or its membership has been cancelled and runs only to the end of its current period — the $800 includes 12 months of recording, from the date of purchase, or for a gift, from the day the gift is opened. Which of the two applies is shown before you pay. The Life Portrait does not include chapter films after the trailer, or the Everlasting Presence; those come with a membership.

There is no deadline for reaching the three marks. If they are never reached, we do not make the film: when any included recording ends, everything already recorded is kept and can still be downloaded, a membership lets the storyteller keep recording, and a full refund stays available until production starts (see Refunds).

A story with a Life Portrait is not deleted while the film is owed or after it is delivered (section 8).

The mini-documentary (section 2A). If the storyteller has not recorded a first conversation within 30 days of purchase, you are entitled to a full refund. Reply to your receipt or write to hello@theeverlasting.ai and we will refund the full amount to the card you paid with.

The Life Portrait (section 2B). You can cancel for a full refund at any time until production starts. Production starts on the day we email the buyer (and the storyteller) to say it has begun; we only begin once the three marks are met and the storyteller’s answers are in. After that, the Life Portrait cannot be refunded. A refund ends any recording the Life Portrait included, from the day of the refund; the story itself is kept, and everything in it can still be downloaded. If it was a gift that has not yet been opened, its gift card no longer opens, unless another gift pays for the story. To cancel, reply to your receipt or write to hello@theeverlasting.ai.

Memberships can be cancelled at any time, as described in section 1. The Professional Studio Kit is covered by the returns terms in section 4.

You own the stories, recordings, photos, and other content you create or upload. You grant us a limited license to host, process, and display that content solely to provide the service to you and the family you designate, and, where you separately consent, to build your everlasting presence as described in the Everlasting Presence Consent. We do not sell your content or use it to build any other person’s presence.

The Professional Studio Kit is an optional one-time physical purchase of $135 plus applicable tax. Title and risk pass on delivery to the address you provide. We aim to ship promptly; delivery times are estimates. Because the kit is a physical product, returns are accepted for unopened items within 30 days of delivery, subject to our returns process; defective items are replaced. Sales tax is calculated at checkout based on your address.

You authorize us and our payment processor (Stripe) to charge your payment method for your membership on a recurring basis, and once for any one-time purchase you make, including a one-time gift or a Life Portrait, neither of which recurs. Prices are in U.S. dollars. Applicable sales tax is added where required. Failed payments may result in suspension of the service until resolved.

You agree to upload only content you have the right to share, to record only people who have agreed to be recorded, and not to use the service unlawfully or to harm others. We may remove content or suspend accounts that violate these Terms.

Certain features — voice generation and the conversational presence — use artificial intelligence to create a representation of you from your own content. These representations are recreations, not statements you personally made, and are provided only under the permissions you grant in the Everlasting Presence Consent. You may change or withdraw those permissions at any time.

You may download your content at any time. If you cancel a membership, we provide a window to export your content before it is scheduled for deletion. A story paid for with a one-time gift has nothing to cancel and is not scheduled for deletion (section 2A). A story with a Life Portrait that has been paid for — waiting for its marks, in production, or delivered — is not deleted, even if a membership on it ends. This includes photos and interviews other family members added to it. Where you have enabled posthumous access, the family you designate may continue to access your archive and presence after your passing, under the permissions then in effect.

The service is provided “as is.” To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.

We may update these Terms; we will note the version and date, and material changes will be communicated. Your continued use after an update means you accept the revised Terms. Questions? Contact hello@theeverlasting.ai.
